The Guidelines on Administrative Fines for Competition Law Violations

In order to establish an ideal supervisory system on Indonesia’s business competition, the Government of Indonesia, through The Business Competition Supervision Commission or Komisi Pengawasan Persaingan Usaha (hereinafter referred to “KPPU”), have attempted to arrange supervisory regulations that do not prioritize criminal sanction towards the business competition violation by issuing KPPU Regulation Number 2 of 2021 concerning Guidelines for Imposition of Penalty for Violation of Monopolistic Practices and Unfair Business Competition (“KPPU Reg 2/2021”) which has been effective since May 31, 2021.

One of the purposes for the issuance of KPPU Reg 2/2021 is to strengthen the function of law enforcement in the business competition climate in Indonesia.

In this ARMA Update, we will discuss the new mechanism of administrative fines calculation that will be imposed on business actors that are found guilty of monopolistic and unfair business practices based on KPPU Reg 2/2021.

PEDOMAN PENGENAAN DENDA ATAS PELANGGARAN PERSAINGAN USAHA

Dalam rangka menciptakan sistem pengawasan yang ideal dalam iklim persaingan usaha di Indonesia, Pemerintah Indonesia melalui Komisi Pengawas Persaingan Usaha (selanjutnya disebut, “KPPU”) telah berusaha menyusun regulasi pengawasan yang tidak mengedepankan sanksi pidana terhadap pelanggaran persaingan usaha dengan menerbitkan Peraturan KPPU Nomor 2/2021 tentang Pedoman Pengenaan Sanksi Denda Pelanggaran Praktek Monopoli dan Persaingan Usaha tidak Sehat (“Perkom 2/2021”) yang telah berlaku sejak 31 Mei 2021. Salah satu tujuan penerbitan Perkom 2/2021 adalah untuk memperkuat fungsi penegakan hukum terkait iklim persaingan usaha di Indonesia.

Dalam ARMA Update kali ini, kami akan membahas mekanisme terbaru dari perthitungan pengenaan denda yang dapat dikenakan kepada pelaku usaha yang dinyatakan melanggar praktik monopoli dan persaingan usaha tidak sehat berdasarkan Perkom 2/2021.
