Government Regulation No. 5 of 2021 and Government Regulation No. 6 of 2021: Ease of Doing Business Through Risk-based Business Licensing

One of the major changes that made by the enactment of Law No. 11 of 2020 on Job Creation (known as Omnibus Law) is the ease in business licensing. Therefore, through its implementing regulations, the Government enacted regulations regarding the risk-based business licensing.

This ARMA Update will discuss the general overview about GR 5/2021 and GR 6/2021 which enacted by Government of Indonesia as implementing regulations of the provisions of the Articles 7, 8, 9, 10 and 11 of the Omnibus Law. In addition, it also addresses the basic information to understand GR 5/2021 and GR 6/2021 as well as some insight that related to the scope of risk-based business licensing, norms, procedures, and sub-sectors, institution that publishes risk-based business licenses, violation and sanction, as well as transition provisions.

Peraturan Pemerintah No. 5 Tahun 2021 dan Peraturan Pemerintah No. 6 Tahun 2021: Kemudahan Berusaha melalui Perizinan Berusaha Berbasis Risiko

Salah satu perubahan besar dengan diundangkannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja (atau yang dikenal dengan “Omnibus Law”) adalah adanya kemudahan dalam perizinan berusaha. Oleh karena itu, melalui peraturan pelaksananya, Omnibus Law menetapkan kebijakan terkait perizinan berusaha berbasis risiko.

ARMA Update ini akan membahas mengenai gambaran umum PP 5/2021 dan PP 6/2021 yang diterbitkan oleh Pemerintah Indonesia sebagai peraturan pelaksana dari ketentuan Pasal 7, 8, 9, 10, dan 11 dari Omnibus Law. Selain itu, kami juga memfokuskan pada beberapa informasi dasar untuk dapat memahami PP 5/2021 dan PP 6/2021 dan juga beberapa informasi terkait dengan ruang lingkup perizinan berusaha berbasis risiko, norma, prosedur, sub-sektor yang diatur, instansi yang menerbitkan perizinan berusaha berbasis risiko, pelanggaran dan sanksi, serta ketentuan peralihan.
